DOMAIN OWNERSHIP
If you register your domain the ownership of the domain is the registrant. If 1st Website Host registers the domain the ownership belongs to 1st Website Host and the data contained therein belongs to 1st Website Host.CONTENT
If you are maintaining your own website, the content is totally responsible for any content. We do not allow porn, adult sites, or any illegal content. If any inappropriate content your site will be pulled and you will give up all rights to the content.If you have us build your website to place at the top of the search engines. We know a lot about building websites. We do not know about your business or the goals you have in mind for your website. We have to have the content, (the actual words that a visitor to your site would read), provided by you. We will take care of all layout, design and functionality issues, but you have to tell us what to say.
You may take all the time you like in providing us with your content but bear in mind that we build these sites on disk and load them to your domain only after you have approved it. The more time it takes to provide us with your text, the longer it takes to go live.
If you would like help in researching and writing your content, we can do that for you, however, it is beyond the scope of what you are ordering here and would be billed in addition to your regular set up fee. The same applies to script creation and/or development, scripts research, purchase and installation, marketing studies such as keyword research and recommendation, stats and logs analysis and recommendation, affiliate program evaluation and just about anything else related to the web and/or web marketing. All of these services are available to you at a rate of $125 per hour. Substantial discounts are offered to our maintenance clients.
BACKUP DATA
While we make every effort to make copies of your original content as well as any content we provide on your behalf, it is understood that YOU are responsible for maintaining back ups of your data. Since we do not have total access to your site, we can not be held liable for any loss or damage of any data within your domain.PLACEMENT
It is agreed that a large part of the value of hiring 1st Website Host to build your website is our experience with search engines and our ability to place high in the results for a given search term. Since we do not own the domain, and you have total access, we have no control over you or your employees. We can not MAKE you do or not do anything. Furthermore, it is also understood that we do not own, control or influence in anyway, any major search service. We do not pay any fees to any of them and enjoy no confidential information from any representative of any major search service. Therefore, we can not guarantee any specific position on any specific search service at any specific time for any specific search term or keywords.ACCESS TO YOUR SITE
It is your responsibility to provide access to private areas of your domain. We will request access to several sensitive areas including, but not limited to, ftp, email, statistics, site logs, server logs, cgi scripts and other programs. You have the right to refuse access at any time for any reason.SET UP FEE
We want to make it very clear to all concerned parties that you are fully aware that you are authorizing 1st Website Host.com to either charge your credit card or deposit your online check for the amount of $689 USD to cover the expense of building a website. You understand that you will be charged a set up fee of $689.00 as outlined in your order.REFUNDS AND CHARGEBACKS
It is understood that we will allow you to inspect our work and request changes before we upload it to your domain. However, once you have ordered our service, the expense of building it is incurred by us and therefore, once ordered there is no refund or chargeback allowed. If you have any questions about a charge contact us as soon as possible and we will investigate the charge.MONTHLY HOSTING AND/OR MAINTENANCE FEES
If you select to host your domain with us or allow us to maintain the domain for you, it is understood that we do not bill. Your due date will be determined by the date of your order and your $249.00 monthly charge will begin within but not longer than 30 days from time of the order date. Any account that falls due on the last day of any month will be moved to the first day of the following month at no additional charge. There is no grace period.CANCELLATION
It is also understand that you are in no way contractually obligated to continue this service. You may cancel at any time with a thirty day notice prior to your monthly due date and you will not be charged again. But this in no way relieves you of your obligation to pay for the cost of the set up or the monthly fees incurred up until such time as you cancel either by telephone, email or in person. Once you have approved the site you are liable for payment and not entitled to a refund or a chargeback.If payment is not received by the due date, an eMail is sent, if no response the site is pulled after 7 days. After 30 days all data is deleted and the website is put up for sale.
Furthermore, it is understood that 1st Website Host. or any of it's resellers, partners or affiliates make no guarantee of any level of success or income. We only guarantee to have your website set up, per your order, as outlined on our website.
Like any business, we deserve to be paid for services rendered. Monthly fees will be due on the due date. There is no grace period. Furthermore if nonpayment occurs for any reason, promotional pages will be deleted and the placements will be lost. Reinstating the account may require another set up fee. I understand the set up fee is non-refundable.
